Item I - Elections – Curule magistrates – Imperium – Comitia curiata - provisional modification of the Constitution – senatus consultum ultimum (adopted text)

The text

In view of the Constitution in its article III.A., relative to the comitia curiata ;

Considering that the recent resignations of curiate lictors, stated in 2763, may create a difficulty in the application of the first part of this article III.A. which says that : "The comitia curiata (Assembly of Curiae) shall be made up of thirty lictores curiati (lictors of the curia) [...]" (III.A) ;

Considering in effect that this sentence, and specially the "up of", means that our Comitia curiata should be composed of thirty lictors, not 29 and not 31, and that therefore a single resignation would not allow our Comitia working normally ;   Considering the importance of having a Comitia curiata well working, specially from next Kal. Ian. 2764 auc, to invest our elected magistrates cum imperio, with such imperium ;

Considering that the sole mean to amend the Constitution, at least to suspend it so that time be given to a normal modification, is issuing a senatus consultum ultimum,

the Senate of Rome decides:

Article 1 : In the following part of the first sentence of paragraph III, A of the Constitution : “The comitia curiata (Assembly of Curiae) shall be made up of thirty lictores curiati (lictors of the curia) [...]”, the expression "be made up of" shall be replaced by "comprised up to".

Article 2 : The other provisions of paragraph III.A. shall remain unchanged.

Article 3 – The present decision is a senatus consultum ultimum which will be applicable until Kal. Ian. 2765 auc.

Article 4 – The Pontifex Maximus and the consuls are charged of the good execution of the present senatus consultum, which shall be applicable from its publication on, and be included in the Tabularium Nova Romae (Senate section).
